FinishStrong Terms of Service

These Terms of Service govern your use of the FinishStrong mobile application, including any free and paid subscription features. By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

FinishStrong is a product of Lockson Holdings, LLC and is not a separate legal entity.

1. Who We Are

FinishStrong is an iOS training plan application distributed through the Apple App Store.

2. Eligibility

FinishStrong is rated 9+ on the Apple App Store. If you are under the age of 13, you may use the app only with the involvement and supervision of a parent or legal guardian.

By using the app, you represent that you are using it in a manner appropriate for your age and physical condition.

3. Nature of the Service

FinishStrong provides automated running training plans based on limited onboarding information and post workout feedback you voluntarily provide. The app uses simple rules based logic to generate and adjust workouts focused on conservative progression and habit formation.

The app:

• Does not provide medical advice
• Does not diagnose, treat, or prevent any medical condition

4. Medical Disclaimer and Safety Acknowledgment

FinishStrong is not a medical professional and does not provide medical advice.

By using the app, you acknowledge and agree that:

• FinishStrong is not a substitute for professional medical advice
• You should consult a physician before beginning any exercise program, especially if you have underlying health conditions
• You should stop exercising immediately and seek medical attention if you experience pain, dizziness, discomfort, or other concerning symptoms
• You assume all risks associated with physical activity performed in connection with the app

You understand that physical activity involves inherent risks and you voluntarily assume all such risks when using the app.

Half marathon and marathon training plans involve substantially more running volume over a longer period than the app's free or 5K plans. The same disclaimers in this section apply with equal force to those plans.

5. No Warranties or Guarantees

FinishStrong does not guarantee:

• Any specific fitness outcome
• Injury prevention
• Performance improvement
• Suitability of the training plan for your personal health condition

Training plans are generated based on user provided inputs and automated adjustments. Results vary by individual.

6. User Responsibilities

You are responsible for:

• Providing accurate information
• Using your own judgment when following any training plan
• Monitoring your physical condition
• Stopping workouts when appropriate

You agree not to misuse the app or use it in a way that could cause harm to yourself or others.

7. Free and Paid Features

FinishStrong offers both free and paid features.

Free Tier:

The free tier provides a complete, adaptive 4-week running plan with post-workout feedback, plan adjustments, and a rolling 2-week buffer beyond Week 4. The free tier is fully functional and does not require a subscription.

FinishStrong+ (Paid Subscription):

FinishStrong+ is an optional paid subscription that provides goal-oriented training plans. Available goals include a 5K plan with guided interval workouts and walk/run coaching, a 10K pickup offered once a 5K plan is finished when your recent running supports that next step, with no race date and ending in a 10K finisher run, and half marathon and marathon plans with progressive weekly structure and a taper toward your race date. Availability depends on your recent running activity.

FinishStrong+ also includes:

• Two Progress charts: a map of your runs and a record of what your body said along the way, plus a historical FS+ mark on completed workouts and a member-since line in Settings
• A plain, dated record of what your plan changed and why, and schedule control: choose your run days, move an upcoming run, pause a plan and pick it back up later, or start a different plan without losing any history
• Works with Apple Health: runs and walks recorded on a watch or in other apps can count toward your plan, and workouts recorded in FinishStrong can be saved to Apple Health if you choose. You can also send a scheduled workout to a paired Apple Watch

Subscription Terms:

• FinishStrong+ is available as a monthly subscription, annual subscription, or one-time lifetime purchase.
• Monthly and Annual subscriptions include one free trial per person, which applies to either plan but not both. Lifetime has no free trial. The length of the free trial is stated at the time of purchase.
• Payment is charged to your Apple ID account at confirmation of purchase or, when a free trial applies, when the trial ends.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of your current subscription. A higher price applies at renewal only as described under Pricing Changes.
• You can manage and cancel your subscription in your Apple ID account settings at any time.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• Buying Lifetime does not cancel a subscription or free trial you already have. To stop further charges, cancel the subscription in your Apple ID account settings.

Cancellation:

If you cancel a subscription, you retain access to FinishStrong+ features until the end of your current billing period. After that, your goal-oriented plan is paused and the app continues with free tier features. The free plan starts at a week chosen from your running over the last 28 days. Your progress and workout history are preserved. If you resubscribe, your plan resumes where you left off, and the free plan is set aside. Runs you completed on the free plan remain in your history.

For a half marathon or marathon plan, your race date does not change if you pause or lapse. When you resume, the app re-evaluates whether your plan can still reach your original targets by that date and will tell you the result before you continue.

Pricing Changes:

Lockson Holdings, LLC may change the price of FinishStrong+. A new price applies to new purchases after it takes effect; Apple's rules may let some existing or recently lapsed subscribers keep an earlier price. If we raise the price of a subscription you already have, Apple notifies you before the new price applies and, where required, asks for your consent. If consent is required and you do not give it, your subscription does not renew at the new price. Lifetime is a one-time payment and is not charged again. The current price is shown on the FinishStrong+ screen in the app before you buy.

Refunds:

All purchases are processed through Apple. Refund requests must be directed to Apple in accordance with their refund policy.

8. Data and Device Use

All training and workout data is stored locally on your device.

Subscription status is cached locally on your device for offline access. Lockson Holdings, LLC does not receive, store, or process your workout, fitness, or payment data on its own servers. All payment processing is handled by Apple.

You are responsible for managing your device settings, backups, and security protections.

If you choose to connect Apple Health, FinishStrong+ can import running and walking workouts and save workouts you record in FinishStrong. It can check for new workouts in the background, use recent activity to suggest your activity level during eligible setup flows, and read an available route for an eligible workout map. These features depend on permissions and data availability. Import and background checks run only while FinishStrong+ is active. When FinishStrong+ is not active, they pause, and workouts already imported stay in your history. When you resubscribe, import turns back on and brings in runs from the last 28 days. The Privacy Policy describes the data accessed and how it is handled.

9. Analytics and Advertising

FinishStrong uses Google Firebase Analytics to understand app use and improve the app. Events can include limited workout and plan-related fields, such as workout duration, planned duration, session type and completion-percentage bands. The Privacy Policy describes these fields and the collection control available in Settings.

FinishStrong does not display third-party advertisements within the app. Lockson Holdings, LLC may use aggregated, anonymous analytics data to measure the effectiveness of its own advertising campaigns promoting FinishStrong on external platforms.

FinishStrong does not use third-party tracking services.

For FinishStrong+ subscribers who connect Apple Health, any data read from or written to Apple Health is never used for advertising or marketing of any kind, and never reaches Firebase Analytics or Crashlytics in any form. It stays on your device.

The app performs limited local logging for development and debugging purposes only. This information remains on the device and is not transmitted to Lockson Holdings, LLC or any third party.

10. Intellectual Property

All rights, title, and interest in the app, including software, design, and content, are owned by Lockson Holdings, LLC or its licensors.

You are granted a limited, non exclusive, non transferable license to use the app for personal, non commercial purposes.

You may not:

• Copy, modify, or distribute the app
• Reverse engineer or attempt to extract source code
• Use the app for commercial purposes

11. App Availability and Changes

We may:

• Modify or update the app
• Add or remove features
• Suspend or discontinue the app at any time

We are not obligated to provide ongoing support or maintenance.

12. Termination

You may stop using FinishStrong at any time by deleting the app.

We may terminate or restrict access if you violate these Terms or misuse the app.

13. Disclaimer of Liability

To the fullest extent permitted by law:

• FinishStrong is provided "as is" and "as available"
• Lockson Holdings, LLC disclaims all warranties, express or implied
• We are not liable for injuries, losses, or damages arising from your use of the app or your participation in physical activity to the fullest extent permitted by law

14. Limitation of Liability

To the maximum extent permitted by law, Lockson Holdings, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

If liability cannot be excluded, our total liability shall not exceed one hundred U.S. dollars.

15. Indemnification

You agree to indemnify and hold harmless Lockson Holdings, LLC from claims, damages, or expenses arising from:

• Your use of the app
• Your violation of these Terms
• Your participation in physical activity

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be made available through the app or App Store listing.

Continued use of the app after changes take effect constitutes acceptance of the updated Terms.
