FinishStrong Terms of Service

These Terms of Service govern your use of the FinishStrong mobile application, including any free and paid subscription features. By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

FinishStrong is a product of Lockson Holdings, LLC and is not a separate legal entity.

1. Who We Are

FinishStrong is an iOS training plan application distributed through the Apple App Store.

2. Eligibility

FinishStrong is rated 9+ on the Apple App Store. If you are under the age of 13, you may use the app only with the involvement and supervision of a parent or legal guardian.

By using the app, you represent that you are using it in a manner appropriate for your age and physical condition.

3. Nature of the Service

FinishStrong provides automated running training plans based on limited onboarding information and post workout feedback you voluntarily provide. The app uses simple rules based logic to generate and adjust workouts focused on conservative progression and habit formation.

The app:

• Does not provide medical advice
• Does not diagnose, treat, or prevent any medical condition

4. Medical Disclaimer and Safety Acknowledgment

FinishStrong is not a medical professional and does not provide medical advice.

By using the app, you acknowledge and agree that:

• FinishStrong is not a substitute for professional medical advice
• You should consult a physician before beginning any exercise program, especially if you have underlying health conditions
• You should stop exercising immediately and seek medical attention if you experience pain, dizziness, discomfort, or other concerning symptoms
• You assume all risks associated with physical activity performed in connection with the app

You understand that physical activity involves inherent risks and you voluntarily assume all such risks when using the app.

5. No Warranties or Guarantees

FinishStrong does not guarantee:

• Any specific fitness outcome
• Injury prevention
• Performance improvement
• Suitability of the training plan for your personal health condition

Training plans are generated based on user provided inputs and automated adjustments. Results vary by individual.

6. User Responsibilities

You are responsible for:

• Providing accurate information
• Using your own judgment when following any training plan
• Monitoring your physical condition
• Stopping workouts when appropriate

You agree not to misuse the app or use it in a way that could cause harm to yourself or others.

7. Free and Paid Features

FinishStrong offers both free and paid features.

Free Tier:

The free tier provides a complete, adaptive 4-week running plan with post-workout feedback, plan adjustments, and a rolling 2-week buffer beyond Week 4. The free tier is fully functional and does not require a subscription.

FinishStrong+ (Paid Subscription):

FinishStrong+ is an optional paid subscription that provides goal-oriented training plans, including guided interval workouts with walk/run coaching. The current goal available is "Run a 5K."

Subscription Terms:

• FinishStrong+ is available as a monthly subscription, annual subscription, or one-time lifetime purchase.
• Subscriptions include a free trial period. The length of the free trial is stated at the time of purchase.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the same price.
• You can manage and cancel your subscription in your Apple ID account settings at any time.
• Any unused portion of a free trial is forfeited when you purchase a subscription.

Cancellation:

If you cancel a subscription, you retain access to FinishStrong+ features until the end of your current billing period. After that, your goal-oriented plan is paused and the app continues with free tier features. Your progress and workout history are preserved. If you resubscribe, your plan resumes where you left off.

Pricing Changes:

Lockson Holdings, LLC reserves the right to change subscription pricing. You will be notified of any price changes before they take effect. Continued use of the subscription after a price change constitutes acceptance of the new price.

Refunds:

All purchases are processed through Apple. Refund requests must be directed to Apple in accordance with their refund policy.

8. Data and Device Use

FinishStrong operates entirely on your device.

All training and workout data is stored locally on your device. If you use iCloud, your data may sync across your personal devices through your own iCloud account.

Subscription status is cached locally on your device for offline access. Lockson Holdings, LLC does not receive, store, or process your workout, fitness, or payment data on its own servers. All payment processing is handled by Apple.

You are responsible for managing your device settings, backups, and security protections.

9. Analytics and Advertising

FinishStrong uses Google Firebase Analytics to collect anonymous usage data for the purpose of improving the app and supporting advertising campaigns. This data is not linked to your identity and does not include your workout details, training plan data, or personal information.

FinishStrong does not display third-party advertisements within the app. Lockson Holdings, LLC may use aggregated, anonymous analytics data to measure the effectiveness of its own advertising campaigns promoting FinishStrong on external platforms.

FinishStrong does not use third-party tracking services.

The app performs limited local logging for development and debugging purposes only. This information remains on the device and is not transmitted to Lockson Holdings, LLC or any third party.

10. Intellectual Property

All rights, title, and interest in the app, including software, design, and content, are owned by Lockson Holdings, LLC or its licensors.

You are granted a limited, non exclusive, non transferable license to use the app for personal, non commercial purposes.

You may not:

• Copy, modify, or distribute the app
• Reverse engineer or attempt to extract source code
• Use the app for commercial purposes

11. App Availability and Changes

We may:

• Modify or update the app
• Add or remove features
• Suspend or discontinue the app at any time

We are not obligated to provide ongoing support or maintenance.

12. Termination

You may stop using FinishStrong at any time by deleting the app.

We may terminate or restrict access if you violate these Terms or misuse the app.

13. Disclaimer of Liability

To the fullest extent permitted by law:

• FinishStrong is provided "as is" and "as available"
• Lockson Holdings, LLC disclaims all warranties, express or implied
• We are not liable for injuries, losses, or damages arising from your use of the app or your participation in physical activity to the fullest extent permitted by law

14. Limitation of Liability

To the maximum extent permitted by law, Lockson Holdings, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

If liability cannot be excluded, our total liability shall not exceed one hundred U.S. dollars.

15. Indemnification

You agree to indemnify and hold harmless Lockson Holdings, LLC from claims, damages, or expenses arising from:

• Your use of the app
• Your violation of these Terms
• Your participation in physical activity

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be made available through the app or App Store listing.

Continued use of the app after changes take effect constitutes acceptance of the updated Terms.
